David Banks

David Banks is a highly experienced company and trusts lawyer and specialises in advising funds and their functionaries on all aspects of Jersey's legal and regulatory regimes.
David's specialist commercial legal background combined with his in-depth regulatory know-how and experience make him a leading expert on all matters concerning Jersey funds, on the recent significant development of funds law, codes and policy and on all associated matters of funds supervision and investigation.
Until 2005 David was in private practice as an Advocate specialising in commercial and trusts law, including funds, companies and insolvency, and head of commercial law at a different Jersey law firm. 2006-2012 David was the Director of Securities with the Jersey Financial Services Commission where he was responsible for the authorisation and supervision of Jersey funds and functionaries. As head of Investment Business he was also responsible for supervising investment advisers. In this role, David worked closely with senior EU officials in Brussels, ESMA in Paris, and the FCA and other overseas regulators.
David devised and implemented many required sweeping reforms of Jersey's funds regime, including the responses to the AIFMD, changes to closed-end listed, unregulated and expert funds and the new Funds Prospectus Order.
In addition, David managed alongside the Commission's Enforcement Division some of the most significant funds problem cases to face the Island concerning public and expert funds and the conduct of the fund managers, administrators and custodians.
